Terms of Service

1. Agreement

These Terms of Service ("Terms") govern your access to and use of PhishFence, a domain monitoring and brand protection service operated by Majuvo LLC, a California limited liability company ("Majuvo", "we", "us"). By creating an account or using PhishFence in any way, you agree to these Terms. If you are using PhishFence on behalf of a company or other organization, you represent that you have the authority to bind that entity to these Terms.

2. The Service

PhishFence monitors the internet for domain names that closely resemble domains you own or operate. The service generates variants of your registered domains (typosquats, homoglyphs, TLD swaps, and similar patterns), checks whether those variants are active, scores them by risk level, and notifies you when threats are detected. PhishFence also provides tools to assist with reporting abuse to domain registrars and phishing databases.

PhishFence is a detection and alerting tool. We do not guarantee that every threatening domain will be identified, that risk scores will be accurate in every case, or that abuse reports will result in takedown. The effectiveness of takedown efforts depends on third-party registrars, hosting providers, and law enforcement agencies outside our control.

3. Accounts and Security

To use PhishFence, you must create an account with a valid email address and a password. You are responsible for keeping your login credentials secure and for all activity that occurs under your account. If you believe your account has been compromised, contact us immediately at support@phishfence.io.

We reserve the right to suspend or close accounts that appear to be fraudulent, that violate these Terms, or that have been inactive for more than 12 consecutive months.

4. Permitted Use

You may use PhishFence to monitor domains that you own, that you are authorized to protect, or that you have a legitimate business interest in monitoring. You may not:

5. Plans and Billing

PhishFence offers a free tier (one monitored domain, limited features) and paid subscription plans with expanded capabilities. Paid plans are billed monthly through Stripe. Pricing, feature availability, and domain limits for each plan are listed on our pricing page.

When you subscribe to a paid plan, you authorize us to charge your payment method on a recurring monthly basis until you cancel. You may cancel your subscription at any time from the Billing page in your account. Cancellation takes effect at the end of the current billing period; you will retain access to paid features until that date. We do not issue prorated refunds for unused portions of a billing period.

We may change our pricing with 30 days' notice. Price changes apply to the next billing cycle after the notice period.

6. Free Tier

Free accounts may monitor one domain with a limited feature set. The free tier is subject to change or discontinuation at our discretion. We will provide reasonable notice before removing or materially reducing free tier functionality.

7. Data Ownership and Privacy

You retain ownership of any data you provide to PhishFence, including the domains you register for monitoring. Scan results, alerts, and reports generated by the service are produced for your use and are accessible only through your authenticated account.

Our collection, use, and storage of personal information is described in our Privacy Policy, which is incorporated into these Terms by reference.

8. API Access

Paid plans may include access to the PhishFence REST API. API tokens are tied to your account, must be kept confidential, and may be revoked at any time from your Settings page. We may impose rate limits on API usage. Excessive or abusive API usage may result in temporary or permanent revocation of API access.

9. Third-Party Services

PhishFence integrates with third-party services including Stripe (payments), public RDAP/WHOIS databases (registrar lookups), Certificate Transparency logs (certificate monitoring), and phishing reporting services such as Netcraft, Google Safe Browsing, and PhishTank. We are not responsible for the availability, accuracy, or actions of these third-party services. Your use of third-party services is subject to their respective terms and policies.

10. Disclaimer of Warranties

PhishFence is provided on an "as is" and "as available" basis. Majuvo makes no warranties, express or implied, regarding the service, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

11. Limitation of Liability

To the fullest extent permitted by applicable law, Majuvo LLC and its officers, employees, and contractors shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of PhishFence. This includes, without limitation, damages resulting from phishing attacks, email spoofing, brand impersonation, data breaches, loss of business, or failure to detect or prevent a threat.

Our total aggregate liability for any claims arising under these Terms shall not exceed the amount you paid to Majuvo for the service during the twelve (12) months preceding the claim.

12. Indemnification

You agree to indemnify and hold harmless Majuvo LLC from any claims, damages, losses, or expenses (including reasonable legal fees) arising from your use of the service, your violation of these Terms, or your infringement of any third-party rights.

13. Termination

You may close your account at any time from the Settings page. We may suspend or terminate your account if you breach these Terms or if we determine, in our reasonable judgment, that your use of the service poses a risk to us or other users.

Upon account closure, we will retain your data for 30 days to allow for recovery if the closure was accidental. After 30 days, all account data (monitored domains, alerts, scan history, and reports) will be permanently deleted.

14. Governing Law

These Terms are governed by the laws of the State of California, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be resolved in the state or federal courts located in California.

15. Changes to These Terms

We may revise these Terms from time to time. When we make changes, we will update the effective date at the top of this page and, for material changes, notify you by email or through a notice in the service. Your continued use of PhishFence after a revision takes effect constitutes your acceptance of the updated Terms.
